A funeral plan provider’s financial difficulties require specialist regulatory attention. Plan holders’ future arrangements, backing assets and continuity planning cannot be treated as ordinary retail deposits.
Establish whether the business is a plan provider, intermediary or funeral director, and identify its permissions. Preserve complete plan records and bring regulatory correspondence to the first discussion. FCA rules address arrangements for continuity or reimbursement on provider failure.
The first question is whether the underlying business can meet its ongoing costs after realistic changes. A business rescue review can examine margins, creditor discussions and the resources needed to keep delivering work. Where tax arrears are part of the problem, HMRC Time to Pay depends on an acceptable, affordable proposal; approval is not guaranteed.
For a suitable limited company, a Company Voluntary Arrangement or administration may warrant consideration. If recovery is not viable, read about Creditors’ Voluntary Liquidation. Formal appointments require a licensed insolvency practitioner. The right route depends on the legal structure, jurisdiction and facts, not the sector label alone.
Bring recent accounts, a current bank balance and a list of overdue payments. For funeral plan providers, also prepare records covering plan-holder records and future obligations; trust or insurance arrangements; fca permissions and wind-down planning. Identify any payment demand, hearing or other deadline at the start of the conversation.
Ask for the proposed scope of work, likely fees and any assumptions in writing before agreeing to a paid service. An initial enquiry does not commit you to a procedure. Complete the enquiry form or call 01246 912052 to explain the position.
If a deadline is approaching, tell us the date when you call.
Any proposed transfer needs regulatory and contractual assessment. A willing buyer does not itself establish that the plans can move or that customers will receive identical arrangements.
Protection depends on eligibility and the relevant arrangements. Refer customers to the FCA and FSCS guidance for their circumstances rather than giving a blanket promise of compensation.
Do not assume that funds or assets backing plans are available for general trading liabilities. Their legal status and restrictions need specialist review.
